We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website, then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and GIA STUDIO rights and obligations to each other.

 

LIMITATION OF LIABILITY
It is an essential pre-condition to you using our website that you agree and accept that GIA STUDIO is not legally responsible for any loss or damage you might suffer related to your use of the website, www.GIASTUDIO.com.au, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

 

COMPETITION AND CONSUMER ACT
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), GIA STUDIO liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website to purchase any alcohol products.

 

PRICE
All prices are shown in Australian dollars and include all taxes, where applicable.

 

SUBSTITUTIONS

GIA STUDIO cannot guarantee the exact colour or variations of any flowers shown in images, substitution may be necessary. This may be due to a number of reasons that are not possible to predict, like seasonal or colour availability. If a substitution is required GIA STUDIO will make every effort to inform the sender. This option may not always be possible due to time constraint, GIA STUDIO may do ahead with the substitution without notifying the sender to prevent delays.

In the case of a substitution GIA STUDIO guarantee to always substitute flowers of equal or higher value and will keep with the style of the original bloom chosen.

 

DELIVERY, RE-DELIVERY, WEEKEND & PUBLIC HOLIDAYS DELIVERY

It is the purchasers’ responsibility to ensure all goods delivered to secure addresses (eg - apartments and units) will be received by the recipient. In situation where the there is no one to receive the blooms, GIA STUDIO will leave the blooms at the safest spot away from sun exposure. Unsuccessful deliveries will result in the goods returned to GIA STUDIO incurring additional fees to the purchaser. Collection of goods from GIA STUDIO is available or the redelivery of goods. The redelivery of goods will incur an additional delivery fee to the purchaser.

GIA STUDIO uses multiple reputable courier companies to deliver physical goods. Deliveries are processed promptly upon receipt of full payment. Delivery times may vary depending on the delivery company chosen. GIA STUDIO is not responsible for goods that are either damaged in transit or not received. GIA STUDIO should be notified immediately of damaged or lost goods. Replacement of damaged or lost items is made at the discretion of GIA STUDIO.  

GIA STUDIO delivers from Monday – Saturday every week. GIA STUDIO does not deliver on Sunday or Public Holidays. If a Saturday delivery is selected, the purchaser accepts the blooms can be left without signature at the recipient’s address.  

 

CANCELLATION

Should you need to cancel your order, the full amount will be refunded, ONLY IF notice is received by GIA STUDIO 48 hours prior to the scheduled delivery date. Cancellations received with less than 48 hours’ notice prior to the date of delivery will be charged at 50% of the total order value. We are unable to cancel orders that have already been created and are in the process of being delivered.

 

RETURNS AND REFUNDS

GIA STUDIO handles return and processes refunds in accordance with the Australian Consumer Protection legislation.

Products sold on this website are a perishable, natural item and flowers life span is dependent on species, resulting in some flower varieties living longer than others. Flowers are a product of nature; availability is dependent on season and markets. As a result, not all goods produced are as pictured on www.GIASTUDIO.com.au, by accepting these terms and conditions you are acknowledging there may be discrepancies between images and produced goods.

GIA STUDIO blooms can be expected to last between 4-7 days if they well looked after. Flower caring instruction can be found at Caring Tips.  GIAS STUDIO is not responsible for lack of care once delivered.

GIA STUDIO must be notified within three (3) days of purchase. GIA STUDIO will not accept returns based on change of mind or design. In cases of flowers perishing within three (3) days of purchase and all care instructions have been followed or if GIA STUDIO produced the incorrect goods, GIA STUDIO will provide a replacement or gift certificate. The value of the gift certificate or replacement is at the discretion of GIA STUDIO. GIA STUDIO reserves the right to request images of original goods for our records. Replacement flowers will not be sent if the original goods have been disposed of or images have not been produced.

 

GIA STUDIO does not offer refund if incorrect delivery information is given to us. It is the sender’s responsibility to provide accurate delivery instructions. GIA STUDIO will get in touch to discuss further and offer re-delivery of goods with an additional fee or store pick up is available within store business hours.
